By downloading, installing, or using the App, you accept this Agreement in full. If you do not agree to these terms, do not download or use the App. Where the App requires you to click to accept these terms, such acceptance supplements and does not replace the acceptance given by your use of the App.
1. Definitions and interpretation
1.1 In this Agreement, the following terms have the meanings set out below.
1.1.1 "App" means the Reverse Audio mobile application, including all updates, modifications, and supplemental features provided by us.
1.1.2 "Intellectual Property Rights" means all patents, copyright, database rights, trade marks, design rights, trade secrets, and all other intellectual property rights, whether registered or unregistered, anywhere in the world.
1.1.3 "Personal Data" has the meaning given in the UK General Data Protection Regulation ("UK GDPR").
1.1.4 "Platform Rules" means the applicable terms of service of the platform through which you downloaded the App, being either the Apple App Store or Google Play Store.
1.1.5 "Pro" means the paid subscription tier of the App, and "Pro Features" means the features unlocked by it.
1.1.6 "Your Content" means audio you record using the App, together with any challenge attempts, scores, and exported files derived from it.
1.2 References to "including" mean "including without limitation". Headings are for convenience only and do not affect interpretation.
2. Grant of licence
2.1 Subject to your compliance with this Agreement, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on a device that you own or control, solely for your own personal, non-commercial purposes.
2.2 You may not:
- copy, modify, translate, adapt, or create derivative works based on the App;
- sell, sublicence, rent, lease, or transfer the App or any rights in it to any third party;
- reverse engineer, decompile, or disassemble the App, except to the extent expressly permitted by applicable law; or
- use the App for any unlawful purpose or in a way that violates this Agreement.
2.3 Your use of the App must comply with the Platform Rules. In the event of a conflict between this Agreement and the Platform Rules, the Platform Rules take precedence.
2.4 All rights not expressly granted under this Agreement are reserved by us.
3. Eligibility and acceptable use
3.1 You must be at least 13 years old to use the App. By using the App, you confirm that you meet this requirement. If you are under 18, you confirm that you have obtained the consent of a parent or legal guardian.
3.2 You must use the App lawfully and in accordance with its intended purpose.
3.3 You must not:
- record any person without their knowledge and consent, or in any circumstance where recording them would be unlawful;
- record, reverse, or export material in which someone else holds copyright, including commercial music, unless you have the right to do so;
- use the App to create material that is defamatory, harassing, threatening, obscene, or otherwise unlawful, including by manipulating a recording of another person to make them appear to say something they did not say;
- use the App to harm, harass, impersonate, or defraud any person;
- upload or transmit malicious code, viruses, or disruptive software;
- attempt to gain unauthorised access to the App or any related systems; or
- circumvent or interfere with the security features of the App, including any mechanism that controls access to Pro Features.
3.4 We may suspend or terminate your access to the App immediately if we reasonably believe you have breached this clause 3.
4. Recording other people
4.1 The App records audio through your device's microphone. You are solely responsible for ensuring that you have the right to make any recording you make.
4.2 The law on recording other people varies by country and by circumstance, and in some places recording a conversation without the consent of everyone involved is a criminal offence. It is your responsibility to know and follow the law where you are.
4.3 Reversing audio does not remove anybody's rights in it. A recording of another person remains their voice, and material subject to copyright remains subject to copyright, whichever direction it is played in.
4.4 We have no ability to review what you record, because Your Content never leaves your device. That places the responsibility for it entirely with you, and we accept no liability for any recording you make, keep, or share.
5. Your Content
5.1 You own Your Content. This Agreement grants us no licence over it, and we claim no rights in it.
5.2 Your Content is created, processed, scored, and stored entirely on your own device. We do not receive it, host it, back it up, or have any means of accessing it. Our Privacy Policy explains this in full.
5.3 Because we hold no copy, we cannot recover Your Content for you. If you delete it, uninstall the App, lose your device, or your device fails, it is gone. If a recording matters to you, export it and keep your own backup.
5.4 If you choose to export or share Your Content to another app or service, you do so under that service's terms, and any rights you grant it are a matter between you and that service.
6. Pro subscriptions
6.1 The core function of the App, recording audio and playing it back reversed, is free to use and is not limited by the number of times you use it.
6.2 Pro is an optional paid subscription that unlocks additional features. The price, billing period, and any free trial are shown to you inside the App before you commit to a purchase, and take effect from the point of purchase.
6.3 Payment, renewal, and cancellation are handled by the app store you bought through, being Apple or Google, under that store's own terms and using your existing account with it. We never see or store your payment card details.
6.4 Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. You cancel through your Apple or Google account settings, not through us, and we have no ability to cancel a subscription on your behalf.
6.5 Where a free trial is offered, any unused portion is forfeited if you purchase a subscription during the trial period.
6.6 Refunds are handled by Apple or Google under their published policies, and we are not able to issue a refund directly for a purchase made through their stores. If you believe you are entitled to a refund, apply to the relevant store. If you think we have got something wrong, contact us anyway and we will help where we can.
6.7 We may change the price of Pro or the features it includes. Where a change materially reduces what an existing subscription provides, we will notify you before it takes effect, and you may cancel.
6.8 If you are a consumer in the UK or EU, you have a statutory right to cancel a purchase within 14 days. That right is exercised through the store you purchased from, and may be lost once you have started using digital content you have asked to be supplied immediately.
7. Intellectual property
7.1 All Intellectual Property Rights in the App, including its design, software, audio processing, scoring logic, bundled challenge audio, and underlying technology, belong to us or our licensors. This Agreement does not transfer any ownership of those rights to you.
7.2 The challenge clips bundled with the App are licensed to you for use inside the App only. You may share an export of your own attempt at a challenge, but you may not extract, redistribute, or commercially exploit the bundled audio itself.
8. The App is entertainment, not a measurement tool
8.1 The Reverse Singing Challenge produces a similarity score. That score is a game mechanic intended to be entertaining, not an objective or scientific measurement of your performance, your voice, or your ability.
8.2 Scoring is approximate by design and may produce results that seem generous or harsh. Nothing in the App should be relied on as an assessment of skill, and no decision of any consequence should be based on it.
9. Availability and updates
9.1 We may update or modify the App from time to time, including to improve functionality, fix errors, or comply with legal or regulatory requirements. Some updates may be required for continued use of the App.
9.2 We do not guarantee that the App will be available uninterrupted or error-free, or that it will remain compatible with every future version of your device's operating system.
9.3 We may amend this Agreement at any time by posting the updated version within the App or on our website and, where practicable, notifying you of material changes. Your continued use of the App following notification constitutes acceptance of the updated terms. If you do not accept the amended terms, you must stop using the App and uninstall it.
10. Limitation of liability
10.1 The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties, conditions, or representations relating to the App, whether express or implied, including any implied warranty of satisfactory quality, fitness for a particular purpose, or non-infringement.
10.2 To the maximum extent permitted by law, we are not liable for:
- any indirect, incidental, special, or consequential loss arising from your use of or inability to use the App;
- loss of data, profits, revenue, goodwill, or opportunity;
- loss of, or inability to recover, Your Content, which is stored on your device alone and of which we hold no copy;
- any claim brought against you arising from a recording you made, kept, or shared, including any claim relating to consent, privacy, defamation, or copyright; or
- any loss arising from reliance on a similarity score or any other output of the App.
10.3 Nothing in this Agreement excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot lawfully be excluded or limited under applicable law.
10.4 If you are a consumer, you may have statutory rights that this Agreement does not affect, including rights under the Consumer Rights Act 2015.
11. Privacy and data protection
11.1 We process Personal Data in connection with your use of the App in accordance with our Privacy Policy. We encourage you to read it before using the App.
11.2 We comply with the UK GDPR and the Data Protection Act 2018. The Privacy Policy sets out the legal basis on which we process your data, what data we collect, how we use it, and your rights in relation to it.
12. Termination
12.1 This Agreement continues until terminated. We may suspend or terminate your licence and access to the App immediately if:
- you breach any provision of this Agreement; or
- we reasonably consider that your use of the App poses a risk to other users, to us, or to the integrity of the App.
12.2 You may stop using the App and terminate this Agreement at any time by uninstalling the App from your device. Uninstalling deletes Your Content, which cannot be recovered.
12.3 Termination does not automatically cancel a Pro subscription bought through Apple or Google. Cancel it through your account with that store.
12.4 On termination for any reason:
- your licence under clause 2.1 ceases immediately;
- you must delete all copies of the App in your possession or control; and
- clauses 4, 5, 7, 8, 10 and 13 survive termination and continue in force.
13. General
13.1 Governing law. This Agreement is governed by the laws of England and Wales. Any dispute arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13.2 Severability. If any provision of this Agreement is held to be unenforceable or invalid, it shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
13.3 Entire agreement. This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and us in relation to the App and supersedes all prior agreements or understandings relating to its subject matter.
13.4 No waiver. Failure or delay by us to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy.
13.5 Third parties. Apple and Google are third-party beneficiaries of this Agreement to the extent required by their Platform Rules, and may enforce it against you. No other person who is not a party to this Agreement has any right to enforce it.
13.6 Contact. Questions about this Agreement can be sent to privacy@sidequestdigital.co.uk, or raised through our support page.
